Terms of Use and Sale
Terms for using Chapter Cay
Effective date: September 21, 2026
Business identity and contact: Wesley Campbell trading as Chapter Cay, East Alexandria Blvd, Nassau, Bahamas; hello@chaptercay.com. The launch is limited to customers located in The Bahamas who are at least 18 years old. These Terms are governed by the laws of The Bahamas, subject to rights that cannot be waived under those laws.
Chapter Cay provides personal access to digital fiction through a monthly membership and one-time archive purchases. Content is licensed for an individual customer’s personal, non-commercial use; it is not sold for copying, redistribution, resale, scraping, or public display.
Eligibility and accounts
Customers must be at least 18 years old, located in The Bahamas at the time of purchase, and legally able to enter a contract. Account information must be accurate and kept up to date. Each customer is responsible for protecting the account password and for activity under the account. An account and its story access may not be sold, transferred, or shared with another person. Suspected unauthorized access should be reported promptly to hello@chaptercay.com.
Monthly membership
The launch membership costs $2.99 USD per month and renews automatically each month until cancelled. The checkout and account pages show the applicable price and renewal terms before purchase. A current membership unlocks released Parts in Volumes that remain in the current catalogue; it does not grant permanent ownership of those Volumes.
A customer may cancel from My Account → Subscriptions. Cancellation stops future renewals, and membership access continues through the period already paid for. If online cancellation does not work, the customer may email hello@chaptercay.com from the address on the account and Chapter Cay will confirm the cancellation by email. If a renewal payment fails, Chapter Cay or its payment provider may retry the charge or place the membership on hold or cancel it. A failed membership payment does not remove separately purchased Volume or Series access.
Parts, Volumes, and Series purchases
New Parts are released weekly. Ten ordered Parts form a Volume. After a Volume is completed and archived, it may be purchased for $7.99 USD for permanent account access.
When at least three archived Volumes from one Series are offered together, the Series collection costs 20% less than the current-price subtotal of the included Volumes the customer does not already own. Before checkout, Chapter Cay identifies the exact included Volumes and any Volumes already owned. A Series purchase is a fixed snapshot: later Volumes are not added unless the product explicitly says they are included. A customer who already owns every included Volume cannot purchase the same collection again.
“Permanent access” means continuing personal access through the customer’s Chapter Cay account while Chapter Cay operates the service, the account remains in good standing, and Chapter Cay is legally able to provide the work. It does not transfer copyright, guarantee a downloadable file, or promise that the technology will operate forever. If Chapter Cay permanently withdraws a purchased work for a legal, rights, security, or service reason unrelated to customer misconduct, Chapter Cay will provide the remedy required by applicable law and the Refund Policy.
Payments, prices, and taxes
Payments are handled by WooCommerce and PayPal. By placing an order, the customer authorizes the displayed one-time charge or recurring membership charge. Prices are shown in USD. Under the approved Bahamas-only launch treatment, VAT will not be added at this time. Any later tax, price, payment method, or territory change requires professional review, clear disclosure, configuration, and staging testing before it takes effect. Customers remain responsible for charges imposed independently by their bank or payment provider.
Refunds and billing corrections are governed by the Refund Policy, including the 14-day voluntary request period and the rules for duplicate, incorrect, or access-failure charges. Mandatory rights under Bahamas law are not limited by these Terms.
Acceptable use and intellectual property
Chapter Cay and its licensors retain all rights in the site, branding, stories, artwork, software, and other content. A customer receives only a limited, personal, non-exclusive, non-transferable, revocable licence to use the service as these Terms allow. A customer must not copy or redistribute substantial content; share paid access; bypass release, membership, or purchase controls; scrape or automate access; interfere with security or operation; introduce malicious code; impersonate another person; or use the service unlawfully.
Chapter Cay may investigate suspected misuse and may suspend or close an account when reasonably necessary to protect customers, content, rights, or the service. Where practical, Chapter Cay will provide notice and a chance to resolve the issue. Records may be retained where law, security, fraud prevention, accounting, or a dispute requires it. Account closure does not remove payment obligations or rights that already arose.
Service availability and third parties
Chapter Cay aims to provide reliable weekly releases and account access, but maintenance, internet failures, security events, provider outages, legal requirements, or circumstances outside reasonable control may interrupt the service. Schedules and catalogue availability may change when reasonably necessary. Material changes affecting a paid entitlement will be communicated where practical and handled under applicable law and the Refund Policy.
Hosting and payments rely on third-party services including Hostinger and PayPal. Their own terms and privacy notices govern the services they provide directly. Chapter Cay is not responsible for a third party’s independent acts or outages beyond the responsibility that applicable law places on Chapter Cay.
The service is provided with reasonable care and skill. Nothing in these Terms excludes a warranty, remedy, or liability that cannot lawfully be excluded. To the fullest extent permitted by Bahamas law, Chapter Cay is not responsible for indirect or consequential loss that was not reasonably foreseeable when the customer accepted these Terms.
Changes and disputes
Chapter Cay may update these Terms to reflect service, legal, security, or operational changes. Material changes will be announced in advance through the site, account, or account email where reasonably possible and will state when they take effect. A less favorable refund rule will not be applied retroactively to an earlier charge.
For a dispute, contact hello@chaptercay.com and allow 30 days for a good-faith written resolution before court proceedings. The courts of The Bahamas are the agreed forum, subject to any right or remedy that cannot be waived under the laws of The Bahamas.
Questions about these Terms may be sent to hello@chaptercay.com.
